SHOKEILo que hacen los artesanos de Japón, en la vida diaria de todo el mundo.

TERMS

Términos

Article 1 (Scope)

These Terms set out the conditions for using SHOKEI STORE (the website and the iOS/Android apps; the "Store"), operated by SHOKEI Inc. ("SHOKEI"). They apply to everyone who browses or uses the Store ("you").

By purchasing a work or registering as a member you agree to these Terms. If you do not agree, you may not use the Store.

The guides published on the Store (how to buy, shipping, returns and so on) form part of these Terms. Where a guide and these Terms differ, these Terms prevail.

Article 2 (Definitions)

"Maker" means an artisan or artist who has entrusted SHOKEI with listing their works on the Store.

"Work" means a craft, artwork or other item listed on the Store: "in stock" (ships right away), "made to order" (made after your order) or "one of a kind" (a single existing piece).

"Member" means a user who has registered under Article 4.

"Reference work" means a past work shown as part of a maker's portfolio that is not for sale.

Article 3 (Role of the Store)

SHOKEI lists, sells, takes orders, processes payment and handles customer service for every work on the Store. SHOKEI is the seller; the maker makes and ships the work.

Works are listed by SHOKEI with the maker's consent, based on the information (photos, text, dimensions, materials) received from the maker. SHOKEI checks the listings, but because the works are handmade small differences between the listing and the actual piece can occur.

Origin statements such as "Made in Japan" are shown on the basis of evidence provided by the maker.

Photographs, texts, films, logos and other content belong to the makers or SHOKEI. Reproduction or alteration beyond private use is not permitted.

Article 4 (Membership)

Registration requires an e-mail address, your name, telephone number, address, year of birth and gender. Please enter true and accurate information and update it on My Page when it changes.

Only you may register your own account. Minors must obtain a guardian's consent before registering or purchasing.

You log in with a 6-digit code sent by e-mail, an e-mail link, a password or a passkey. Keep them to yourself. Except in cases of SHOKEI's wilful misconduct or gross negligence, SHOKEI is not liable for damage caused by a third party using them.

SHOKEI may refuse or suspend registration if (1) false information was given, (2) you have breached these Terms before, (3) SHOKEI judges you to belong to or be involved with anti-social forces, or (4) SHOKEI otherwise judges it inappropriate.

Article 5 (Orders and formation of contract)

You place an order after confirming the work, quantity, delivery address and payment method on the checkout page and agreeing to these Terms and the return conditions.

The sales contract is formed when SHOKEI sends the order confirmation e-mail. SHOKEI's obligation to deliver arises when card payment is completed or, for bank transfer, when SHOKEI confirms receipt of the payment.

SHOKEI may cancel an order even after the contract is formed if (1) the work is out of stock or a one-of-a-kind piece has already been sold, (2) the maker can no longer make it, (3) the delivery or contact details are incomplete and you cannot be reached, or (4) SHOKEI judges the order inappropriate, such as for resale. Any payment received is refunded in full.

For one-of-a-kind works, the order whose checkout started first takes priority. Unpaid orders may be cancelled after a period and the work put back on sale.

Article 6 (Prices and payment)

Prices shown on each work page include Japanese consumption tax. Shipping is charged in addition (a flat rate within Japan; flat regional rates overseas; except works marked shipping included). Bank transfer fees are borne by you.

Payment methods are credit card, Apple Pay and Google Pay (on the Square payment page; SHOKEI does not store card details) or bank transfer in advance (deliveries within Japan only).

Card payments are completed at the time of order. Bank transfers must be made within 7 days of SHOKEI's notice; otherwise the order may be cancelled.

Overseas deliveries are card only, in Japanese yen. Import duties, taxes and customs fees are paid by the recipient. If delivery is refused for these reasons, the refund is made after deducting round-trip shipping and fees.

For works marked "price on request" and for commissions, the contract is formed when you accept SHOKEI's quotation.

Article 7 (Delivery)

In-stock works ship within 2 business days after payment is confirmed. Made-to-order works ship after the production period stated on the work page, which is an estimate and may vary because the work is handmade.

SHOKEI e-mails you when the production start and planned shipping dates are set, and again if there is a significant delay.

The maker ships with a trackable service. The tracking number is e-mailed when the work ships.

Works from several makers ordered together arrive separately.

Even a one-of-a-kind work is shipped only after the maker has finished it (signing the box, final finishing, seal), so it can take up to about 2 months from order to shipping. Made-to-order works may likewise exceed the production period shown on the work page. If you are in a hurry, please contact us before ordering.

Article 8 (The nature of handmade work)

Every work on the Store is made by hand, one piece at a time. Please understand in advance that the following are not defects or breaches of contract.

(1) Colour, brushwork, wood grain, glaze flow or weave differing from the photographs or sample. No two pieces are the same, even under the same title.

(2) Dimensions and weight varying by a few millimetres or grams from the stated values.

(3) Longer production times due to materials and seasons, such as lacquer curing, humidity adjustment of paper and wood, or drying of painted surfaces. Delays are more likely in the rainy season, midsummer and midwinter.

(4) Late arrival of materials (gold leaf, pigments, paper, wood blanks and so on) delaying the start of production.

(5) Temporary pauses in production or shipping because of the maker's exhibitions, travel or health. SHOKEI will inform you of a new schedule.

(6) Changes over time in natural materials: colours deepening, lustre changing, wood moving. These are the character of the work, not faults.

If production is delayed by more than one month beyond the original schedule, SHOKEI will contact you and you may cancel the order (except after production of a made-to-order work has started; any payment received is refunded in full).

Please care for the work as described in "Care and handling" on its page. Damage caused by use or storage contrary to that guidance is not covered by exchange or refund. Repairs are arranged through SHOKEI in consultation with the maker and may be charged.

Article 9 (Confirming receipt and defects)

When the work arrives, please confirm receipt from the link in the shipping e-mail. If we hear nothing within 21 days of shipping, the work is treated as received.

If the work arrives damaged, defective or different from your order, report it within 48 hours of arrival via "Report a problem". SHOKEI will replace, repair or refund, and bears the shipping cost in that case.

Handmade works differ slightly from the photographs in colour, texture and dimensions. This is the character of the work and not a defect.

Article 10 (Returns, exchanges and cancellation)

In-stock works may be returned for your own reasons only if unused and within 7 days of arrival. You bear the return shipping and transfer fees; the price of the work is refunded (shipping is not).

Made-to-order works may be cancelled only before the maker starts production. No cancellation or return is accepted after production starts.

One-of-a-kind works, personalised or custom-sized items, and commissions based on reference works cannot be returned or exchanged for your own reasons.

Refunds are made to the card used or, for bank transfers, to an account you specify, within 10 business days after SHOKEI confirms the return.

Article 11 (Commissions)

You may request a commission from a maker page or work page. SHOKEI consults the maker and sends you a quotation and estimated lead time.

Production starts once you accept the quotation and SHOKEI confirms your payment. No cancellation is accepted after production starts.

SHOKEI may decline a commission that infringes third-party rights or is contrary to public order and morals.

Article 12 (Auctions)

Only members may bid. Bids cannot be withdrawn. A bid in the last 5 minutes extends the auction by 5 minutes.

The winner must pay by card within 48 hours. Otherwise the win is void and the right passes to the next bidder.

Where a buy-now price is set, the auction ends as soon as a bid reaches it.

Article 13 (Prohibited conduct)

You must not (1) buy in bulk for resale, (2) impersonate others or register false information, (3) interfere with the operation of the Store or access it without authorisation, (4) approach makers you learned of through the Store for transactions outside the Store, (5) defame or harass makers, SHOKEI or other users, (6) reproduce photographs or texts without permission, or (7) act against the law or public order and morals.

In case of breach SHOKEI may cancel orders, suspend listings, suspend or terminate membership and take other necessary measures.

Article 14 (Personal data and browsing records)

SHOKEI handles your personal data in accordance with the Privacy Policy.

To improve the Store, SHOKEI records browsing activity (pages viewed, elements clicked) only with your consent. Names, addresses and payment details are not recorded. You may withdraw consent at any time.

Your name, address and telephone number are passed to the maker for shipping only. The maker uses them for no other purpose.

Article 15 (Customer testimonials and reports)

Testimonials you submit may be published on the Store after SHOKEI's review. By submitting, you permit SHOKEI to use them free of charge on the Store and in SHOKEI's materials.

You may report a problematic listing via "Report this listing" on work and maker pages. SHOKEI reviews reports and, where necessary, corrects or suspends the listing and consults the maker.

Article 16 (Closing your account)

You can close your account from My Page. If an order is in production or in transit, please wait until delivery is complete.

After closure, order records are kept in anonymised form only to the extent required by law.

Article 17 (Changes and interruption of service)

SHOKEI may change the Store, or suspend or end it, without prior notice.

SHOKEI is not liable when the Store cannot be used for reasons beyond its control, such as network failures, disasters or failures of payment or delivery providers.

Article 18 (Disclaimer and limitation of liability)

SHOKEI strives for accuracy but does not guarantee the completeness or usefulness of the information on the Store.

Except in cases of wilful misconduct or gross negligence, SHOKEI's liability to you is limited to the price of the work concerned.

If you breach these Terms and cause damage to SHOKEI, a maker or a third party, you are liable for that damage.

Article 19 (Changes to these Terms)

SHOKEI may change these Terms when necessary. The changed Terms take effect when posted on this page. Important changes are announced on the Store or by e-mail.

Using the Store after a change constitutes acceptance of the changed Terms.

Article 20 (Governing law and jurisdiction)

These Terms are governed by and construed in accordance with the laws of Japan.

The Tokyo District Court has exclusive jurisdiction in the first instance over any dispute between SHOKEI and you concerning the Store.
